Warranty

24-month limited warranty: Lalapandia Playground warrants to its customers that its products will not fail in structure due to defects in material quality or workmanship during normal use and installation in accordance with Lalapandia Playground's instruction manual.

 

The warranty period begins on the date the customer receives the playground and has it installed by Lalapandia Playground’s professional installation team or an installation team approved by Lalapandia Playground and ends at the end of the following period.

 

It is the customer's responsibility to read and refer to the《Product Instructions》，improper cleaning and maintenance of the equipment will void any warranty terms.

 

The stated warranty is valid only if the product and structure and/or equipment meet the following conditions:

 -Unload from container following Lalapandia Playground's instructions;

  -Proper installation and compliance by Lalapandia Playground’s professional installation team or an installation team approved by Lalapandia Playground;

  -Maintain and inspect the equipment as directed by Lalapandia Playground (this warranty will be void if the playground owner fails to maintain and service the product in accordance with maintenance requirements);

  -Normal use of the product for its intended purpose; do not expose the playground to vandalism, misuse, neglect, accident or unauthorized addition or substitution of parts;

  -It may not be moved in whole or in part after initial installation; no modifications, alterations or repairs may be made by anyone other than the Lalapandia Playground installation team or an installation team approved by Lalapandia Playground, and Lalapandia Playground shall determine, in its sole discretion, whether such actions may affect the condition or operation of the structure.

  -The compressor must be properly maintained, including releasing liquid from the condenser tubes per the manufacturer's instructions. The warranty will be void if the compressor is not properly maintained per the manufacturer's instructions.

 

This warranty does not cover:

1.Cosmetic damage or defects, such as surface scratches, dents, damage, fading, discoloration, corrosion, warping of recycled plastic lumber, and cracking or peeling of surface coatings or paint;

2.Damage due to normal wear and tear. Repairs to items subject to normal wear and tear are the responsibility of the customer and may include, but are not limited to: replacing tie wraps or wraps, repairing nets, repairing loose bolts or fittings, replacing safety flooring or padding. Lalapandia Playground will provide assistance via phone, email or video conference;

3.Damage caused by “Acts of God” such as hail, floods, lightning, tornadoes, sandstorms, earthquakes and windstorms;

4. Damage caused by "Environmental factors" such as windblown sand, salt water, salt spray, or air emissions from industrial sources (sulfur, acid, or corrosive chemicals, rather than normal photochemical smog).

 Labor for any inspection. 

-Labor for replacement of any defective item(s).

-Incidental or consequential damages.

-Vandalism, improper use, failure due to loading or use beyond the capacities stated in the applicable Assembly Manual.

Improper installation by anyone other than the Lalapandia Playground installation team or a Lalapandia Playground-approved installation team, including but not limited to installation on uneven, uneven or soft surfaces.

This warranty is exclusive and in lieu of all other representations and warranties of any kind, whether express, implied, or statutory, including, but not limited to, any warranty of condition, description, merchantability, fitness for a particular purpose, or non-infringement, or any representations or warranties made in any brochures, manuals, catalogs, literature, or other materials of Lalapandia Playground. In addition, no oral or written representations by any Lalapandia Playground representative shall replace or modify the Exclusive Limited Warranty.

 

Exclusive Remedy:

To make a valid claim under this warranty, Lalapandia Playground must receive the customer's written claim statement (including a detailed description of the defect) and a copy of the original invoice, maintenance records and high-resolution photos via Whatsapp, WeChat or other social software or email before the end of the applicable warranty period. If Lalapandia Playground requests, the customer must also ship the damaged parts at their own expense to Lalapandia Playground's address: No. 98, Xibian Road, Xiaojingao Industrial Zone, Qiaoxia Town, Yongjia County, Wenzhou City, Zhejiang Province.

 

If any breach of this warranty is discovered and confirmed during the applicable warranty period, Lalapandia Playground, upon receipt of the requested documentation and photographs and/or defective parts, shall correct such defects by repairing any defective parts or by providing replacement parts at Lalapandia Playground’s option within 60 days of formal receipt of the claim.

 

Replacement parts are provided free of charge during the warranty period, pursuant to Lalapandia Playground’s terms. Parts are shipped to the customer site free of charge during the first 3 months of the warranty period. From the 4th through the 24th month of the warranty period, shipping costs for replacement parts are the responsibility of the customer. Lalapandia Playground is not responsible for labor or the labor costs of removing the defective part and installing any replacement part. The limited warranty shall warrant the original part for the remainder of the applicable warranty period, but shall not be warranted thereafter.

 

Disclaimer of liability: 

To the extent permitted by law, Lalapandia Playground shall not be liable for the following matters in connection with the Products under any circumstances:

(A)Any indirect, special, incidental or consequential damages, whether based on tort, contract or other legal theory, and whether or not advised of the possibility of such damages;

or
(B) any damages in excess of the amount of the purchase price of such products. If the remedies provided herein fail of their essential purpose, the right to recover damages within the limitations set forth shall be Customer's sole and exclusive alternative remedy;

Force Majeure:Lalapandia Playground shall not be responsible for any unforeseen circumstances or causes beyond its control, including but not limited to strikes, lockouts, embargoes, riots, war, acts of terrorism, fire, acts of God, accidents, failure or damage to parts required for order fulfillment, delays caused by subcontractors, suppliers or customers, inability to obtain labor, materials or manufacturing facilities, or compliance with any law, regulation or order.

 

Disclaimer of liability:

Lalapandia Playground shall not be responsible for any unforeseen circumstances or causes beyond its control, including but not limited to strikes, lockouts, embargoes, riots, war, acts of terrorism, fire, acts of God, accidents, failure or damage to parts required for order fulfillment, delays caused by subcontractors, suppliers or customers, inability to obtain labor, materials or manufacturing facilities, or compliance with any law, regulation or order.

 

Savings:

If any part of the terms and conditions set forth herein is held to be invalid or unenforceable, such part shall be deemed severable to the extent of such invalidity or unenforceability and the remaining terms and conditions shall remain in effect, and the remaining terms and conditions shall be deemed amended to remain enforceable to the maximum extent consistent with such determination.

 

Governing Law：

All matters relating to the sale of products or services shall be governed by the laws of the People's Republic of China, notwithstanding any conflicts of law principles.

 

Disputes:

Customer irrevocably consents to the exclusive jurisdiction and venue of the People’s Republic of China (PRC) courts in all matters arising out of or relating to the sale of products and/or services under this Agreement.

 

Design:

Lalapandia Playground is continually improving the equipment available for your play area and therefore reserves the right to alter future design specifications of our products without prior notice.

For products ordered by customers according to old designs and specifications, customer approval must be obtained before changes are made to customer products.
